And now, armed and at the ready with a surprisingly strong ruling from a federal judge that agrees with him, Citron is itching to fight regulation on Voice over IP across the country. It's a home run for Vonage and VoIP, not just in Minnesota, but in all states. Here's the complete text of U.S. District Judge Michael J. Davis' decision to impose a permanent injunction on the Minnesota Public Utilities Commission's efforts to regulate Vonage as a full-fledged phone company. Davis based his decision, the ruling states, on "Congress's desire that information services such as those provided by Vonage must not be regulated by state law enforced by the MPUC. State regulation would effectively decimate Congress's mandate that the Internet remain unfettered by regulation." |

A federal court has issued a permanent injunction against the Minnesota Public Utilities Commission's efforts to regulate Voice over IP provider Vonage as a telephone company. A spokeswoman for Vonage calls the ruling a "significant victory" for the company and the nascent technology. The ruling could have a significant impact as other states across the country, including California, had started to follow Minnesota's lead by regulating VoIP providers. |

A member of the California Public Utilities Commission is calling for public hearings on the agency’s recent demand that Voice over IP service providers apply and be certified as full-fledged telephone companies. Commissioner Susan Kennedy says that it may be too early to regulate VoIP because it's difficult enough for new technologies to succeed "without the heavy hand of government regulators." The matter will be heard during the CPUC Oct. 30th meeting in San Francisco, and may lead to a vote that reverses the agency's action. That vote, though, may be too close to call. |

In what may be the broadest regulatory attack against broadband telephony to date, a staffer at the California Public Utilities Commission has fired off a letter to five VoIP service providers demanding that they register and be certified as telephone companies. One of the five, VoicePulse, does not offer local numbers in the state, but has been given until October 22 to comply with the demand. The action may represent a potentially devastating blow to the nascent communications technology. |

On the heels of last week's announcement by Vonage that it would soon be releasing a proprietary software client for use with its service, VoicePulse will be releasing it's own softphone plan this week, allowing its subscribers to use any telephone software, including XPro, SJPhone and the open-source Asterisk PBX. Unlike Vonage, VoicePulse plans to share previously secret user settings with its customers. |
